Justice Chacha Mwita has ordered the recovery of Ndiang’ui Kinyagia, a 31-year-old blogger and IT expert who has been reported missing since his mysterious disappearance on June 21, 2025. speaking at a High Court proceeding, the judge issued stern orders to Inspector General of Police Douglas Kanja and Directorate of Criminal Investigations (DCI) Director Mohammed Amin regarding Kinyagia’s whereabouts.
“i want him dead or alive”, he reiterated while also simultaneously quering the amount of time it would take to have the victim arraigned before him in court. “there is no way a kenyan will vanish without a trace, it’s not possible, when can we have this person”. The case was brought before the Milimani High Court through a habeas corpus application filed by the Law Society of Kenya (LSK), represented by lawyers including Senior Counsel Martha Karua and Babu Owino, seeking to compel the state to produce Kinyagia, dead or alive.
Kinyagia, known for his online activism under the handle “Daguin Dd” on X, was reportedly abducted by plainclothes individuals believed to be DCI officers. Witnesses described 6–10 unmarked vehicles, including Subarus with distorted number plates, surrounding his residence. Armed men in balaclavas allegedly broke into his home around 9 p.m., bundled him into a vehicle, and sped off.
Both Kanja and Amin failed to appear in court on July 1, 2025, as ordered, sending lawyers to represent them instead. This prompted sharp criticism from Justice Mwita and the petitioners’ legal team.Mwita directed DCI boss Mohammed Amin to personally appear in court on Thursday, July 3, 2025, to explain Kinyagia’s whereabouts. at the same time, The judge reiterated that the prolonged disappearance raised grave concerns about Kinyagia’s safety and the state’s responsibility to protect citizens.
Kinyagia remains missing, with no confirmed sightings since June 21, 2025. His mobile phones are switched off, and his family reported the abduction to Kinoo Police Station (OB Number 16/23/06/2025). The court is scheduled to reconvene on July 3, 2025, with Amin ordered to appear in person to provide answers.
